High Court Won't Review Auditor Lawsuit

CEDAR RAPIDS (CBS 2/FOX 28) -- The Iowa Supreme Court has denied further review of Linn County Auditor Joel Miller's lawsuit against the Linn County Board of Supervisors.

Miller filed the lawsuit against the board, claiming the board was wrong when it did not approve Miller's appointment of deputy auditor. Miller says the board does not have the authority to reduce the number of deputies in the Auditor's Office from four to three, and that the board must temporarily fund the deputy auditor position that the board eliminated.

An Iowa District Court and the Iowa Court of Appeals both ruled in favor of the Linn County Board of Supervisors. With the decision by the Iowa Supreme Court to not review the case, the ruling of the lower courts will stand.
